Tuesday’s FNC “Hannity” featured Sen. Ted Cruz (R. Texas) questioning the merits of Alvin Bragg’s attempt to indict former President Donald Trump.

Cruz called the attempt a political persecution and claimed that the accusation was “bogus.”

He said, “Listen, the short and sweet of it is, this accusation, if it comes in this week, is absolutely outrageous.” It is absurd. It is baseless. It is political persecution. It is not a case. It is targeting Donald Trump because Alvin Bragg, a left-wing Democrat who has a hatred for Donald Trump, is being prosecuted. Legally, this case is absurd.”

Cruz said, “Now, it all depends on two New York statutes, which concern business records, the type of records you keep within your business.” It is a misdemeanor for a business record to be false or fraudulent. Bragg is arguing that Trump gave $130,000 to Michael Cohen to pay Stormy Daniels hush money. He characterized the $130,000 as legal fees. That business record was false and fraudulent.

He said, “Now, he has a problem with that idea, which is under New York State law, that’s only an offense.” This statute has a two year limitation, so you can’t even file this claim now. Bragg must do the second thing. He must bootstrap it into a different New York statute. This makes it a felony to create a false record in aid of commission or of another crime. It is presumably a Federal Elections Commission violation. The FEC declined to bring the case, and the Department of Justice also refused to bring the case. Instead, the Southern District of New York Department of Justice refused the case.

Cruz said that Bob Mueller and the Mueller investigation declined to bring this case. “But Alvin Bragg will try to bring a matter on a theory. They tried it with John Edwards. Remember John Edwards? John Edwards, Democrat senator, had an affair and gave hush money his mistress. They tried to bring him before a court. The case was thrown out of court. This is absurd. It is a bogus attack by a partisan DA.
